The latest state of affairs is a study in contrasts:
- The FCC’s latest privacy framework is under threat. FCC Chairman Ajit Pai released a joint statement with FTC Acting Chairwoman Maureen Ohlhausen issuing a temporary stay of the FCC’s new data security rule. Congress has threatened to step in and roll back the rules with its Congressional Review authority.
- Other agencies, like the FTC, continue to enforce their own privacy and data security requirements on a case-by-case basis.
- States continue to enforce privacy and data breach notification rules, with varying levels of enforcement.
- The European Union is preparing its new privacy regulation, the General Data Protection Regulation (“GDPR”), with its controversial extraterritorial application and heavy penalty system for non-compliance.
