In 2009, the FCC asked Google a series of questions regarding its Google Voice offering, including whether the services were potentially regulated as Interconnected Voice over Internet Protocol Service (“I-VoIP”), telecommunications, and/or telecommunications service. The FCC has not taken direct action in response. However, this does not mean the FCC has moved on from its consideration of the regulatory status of mobile calling apps. The FCC can and may take action on the regulatory status of such services at any time. Additionally, based upon the past conduct of the Universal Service Administrative Company (“USAC”), the Universal Service Fund (“USF”) Administrator, mobile calling apps may be classified as a USF-assessable service in the event of a USAC audit. In short, mobile calling app providers may be out of the frying pan, but not out of the fire! This session will address the potential regulatory classifications and consequences that could befall various flavors of mobile calling apps, including UCaaS and online collaboration tools where voice is a component. Following the 25-minute webinar, Mr. Marashlian will field questions on any legal, tax or regulatory topic, so either come prepared with your questions OR submit your question in advance to Matt Lucas if you want to receive a direct and thorough response to your specific question.
