In 2010, Congress passed the 21st Century Communications and Video Accessibility Act (CVAA) to update our nation’s telecommunications protections for people with disabilities. Because of changed technology, broadband availability & public safety needs, Congress believed existing law did not provide sufficient accessibility to modern communications services and products for people with disabilities. The CVAA and accompanying FCC regulations impose a variety of duties on communications and advanced service providers and manufacturers, including, Video Description, Recordkeeping Compliance, Captioning of Internet Video Programming, Display of Captioning on Equipment Used to View Video Programming. The law provides for penalties for non-compliance and courts are enforcing CVAA obligations through ADA (Americans with Disabilities Act) and state disability act lawsuit. Any company that provides communications-related services or manufacturers communications equipment needs to know about the CVAA and its pitfalls.
